Latest Update on Malaysia My Second Home (MM2H) – 11 May 2026
MOTAC recently organised a refreshment course. Many agents were present. However, unlike previous sessions, there was noticeably less noise on social media afterward. In the past, even before the seminar ended, selective information would already be circulating on platforms like Xiaohongshu and TikTok. This time, things were much quieter.
So what was discussed? Why no one is publishing these “latest” news ?
It appears that the authorities—particularly the Tourism Ministry and Immigration—took this opportunity to “remind” or “warn” agents on several key matters:
Client Assessment & Risk Awareness (KYC)
Agents were specifically reminded to conduct proper customer due diligence (KYC). While not explicitly mandatory under MM2H, it is now clearly being expected. Failure to properly assess clients may result in serious consequences, including license revocation and legal liability.
We implemented our own KYC process in early 2025 and remain one of the few agencies with a 100% approval track record. In fact, we rejected 7–8 applicants in 2025 and 2 more in 2026 due to high rejection risks.Overpromising & Misleading Marketing
Some agents have been making unrealistic promises just to secure deals—telling clients what they want to hear. When issues arise, blame gets shifted. Authorities have warned that complaints will be investigated, and proven misconduct will be penalized.
Remember the “1–2 months approval” claims by influencers? That’s a clear example of misleading marketing.Professional Conduct & Discipline
Regardless of company size or market position, violations will not be tolerated. Agents may face suspension or license cancellation.Submission of False Documents
Submitting false or inaccurate documents can result in fines of RM10,000 and potential civil and criminal liability. Even if the documents were submitted “on your behalf,” responsibility still lies with you.Service Fees
While fees for dependents and additional services are not strictly regulated, authorities expect pricing to remain reasonable. If excessive fees become widespread, price standardization may be introduced.Use of Official Logos
Agents are not allowed to use government logos for marketing without approval, to avoid misleading the public into thinking it is an official endorsement.Company Setup Monitoring
Except for Platinum category applicants, if a company is set up, authorities may verify it with the Companies Commission (SSM). Both agents and applicants may face legal consequences if irregularities are found.
Let’s be honest—some agents still “paint a beautiful picture” just to close deals. Every question you ask gets a “no problem” answer. This is classic sales manipulation—hiding risks to secure commissions. If enforcement becomes stricter, many of these practices will not survive.
Service Agreement & Stamp Duty
When engaging an MM2H agent, you must sign a service agreement. This agreement must now be stamped (paid stamp duty) with the tax authority to be legally valid.

So the question is—why are authorities issuing such strong reminders now? Will it be effective?
Over the years, I have repeatedly shared suggestions with the authorities. If implemented, I firmly believe these issues could be reduced by at least 50% almost immediately.
